Subject : Payment of Salary to Central Government Employees on 28th July, 2016 instead of 29th July 2016 due to bank strike called by UFBU.
It has come to notice of this office that United Forum of Bank Unions (UFBU) has called for a nation wide bank strike on 29,07,2016. This day being the last working day of the month for payment of salary ti all central government employees, it has been decided that Salary for the month of July 2016, be paid to the Central Government employees on 28.07.2016
All Ministries/Departments are requested to payment of salary to their employees on. 28th July 2016.

Selection process for engagement to all approved categories of G.D.S posts

Sub: Selection process for engagement to all approved categories of GDS posts – Review thereof.

            Reference is invited to this Directorate order No.17-39/6/2012-GDS dated 14-01-2015 vide which the revised eligibility criteria for engagement to GDS posts was prescribed.

2.         It has been observed that due to maximum age limit of 30 years many of GDS engaged in their prime youth tend to leave for want of better opportunities and the needy and competent persons who have ceased the maximum age limit criteria are deprived of the opportunity.

3.         Further reference is invited to this Directorate order No.17-39/7/2012-GDS dated 14-01-2015 and letter No.17-39/2012-GDS dated 16-09-2015 in para 2(b) (vii) of aforementioned letter it has been stipulated that “the authority higher to the recruiting authority will nominate a committee constituting of three members including recruiting authority with two others not below the rank of Inspector Posts. Beside the said authority will decide the date on which such committee will meet for finalizing selection”

4.         The above orders have been reviewed and the following amendments are approved by the competent authority and shall take into effect from the date of issue of this letter.

(a)        The entry age to the GDS posts shall be raised up to 40 years of age (further relaxable by 03 years to those belonging to OBC categories and 05 years in case of candidates belonging to SC/ST. Maximum age of Casual Labourers shall be 45 years (48 years for OBC & 50 years for SC/ST) subject to fulfilling other conditions of eligibility.

(b)       The instructions about formation of committee consisting of three members prescribed vide para 2 (b) (viii) of this Directorate letter No.17-39/2012-GDS dated 16-09-2015 be withdrawn and the recruiting authorities may be allowed to continue engagement of GDS without formation of such committee.

Subject: Prevention of Sexual Harassment of working women at workplace – Seniority of the Chairperson of the Complaint Committee – regarding.
The undersigned is directed to say that following the enactment, of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 [SHWW(PPR) Act] and notification of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal).Rules, 2013 [SHWW(PPR) Rules] on 09.12.2013, the Government notified the amendments to Central Civil Services (Conduct) Rules 1964 and Classification, Control and Appeal Rules, 1965. The amendments and other salient features of the Act/ Rules was brought to the notice of all concerned vide Office Memorandum No 11013/02/2014-Estt.A-III dated 27.11.2014.
2. As per Section 4(1) of the SHWW (PPR) Act, 2013, the Internal Complaints Committee (referred to as “Complaints Committee” hereafter) is to be set up at every workplace. As per Section 4(2), this will be headed by a woman and at least half of its members should be women. In case a woman officer of sufficiently senior level is not available in a particular office, an officer from another office may be so appointed. To prevent the possibility of any undue pressure or influence from senior levels, such Complaints Committees should involve a third party, either an NGO or some other body which is familiar with the issue of sexual harassment.
3. As per the amended Rule 14 of the CCS (CCA) Rules, 1965, in cases of sexual harassment, the inquiry is to be conducted by the Complaints Committee in that Ministry/Department. Recently, many references for clarification on the rank of the Chairperson of the Complaints Committee vis a vis the employee against whom the allegations have been made have come to this Department. The matter has been examined in consultation with the Department of Legal Affairs and Ministry of Women & Child Development. It is clarified that the committee constituted in terms of the SHWW (PPR) Act, 2013 is legally competent to hold an inquiry into a case irrespective of the fact that the Chairperson of such Committee is lower in rank to the employee against whom the allegations have been made.
4. All Ministries/ Departments/Offices are requested to bring the above guidelines to the notice of all Disciplinary Authorities under their control.

FLASH NEWS

We are receiving mails &telephonic calls from various levels about 7th CPC . Our federation clarifies the doubts after consulting Top NJCA leader.
1)When Government issued 7th CPC implementation notification?
It is clarified that  the Gazette  notification will be issued by the Government by the end of July , 2016 & Central Government employees will get 7th Cpc  Salary in  the month of August,2016 .    
2)What is the recommendation of   empowered committee Chaired by Cabinet secretary?
Committee recommendation is not disclosed with NJCA leaders. But it is visible report is not accepted by the NDA Government
3)What is the present High level committee?
The present committee consists of  Group of Ministers which includes Finance Minster; Home Minster& Railway   Minister this committee submits is opinion within 4 months.
3a) If the New committee rejected our Demand what is the stand of NJCA?
It is clarified by the NJCA that deferred indefinite strike will revive  
4)What is rate of HRA & other allowances?
According to announcement the HRA will be paid in the ratio of 30% 20%10% for another 4 months & remaining allowances will be paid in the rates in existing Pay structure. High level committee will take final discussion with in time frame of 4months.
5)Whether better settlement is possible if we went on strike on the proposed date of July 11 2016 ?
We cannot presume things on assumption basis but it is sure Government will abide by when    only Railway men go on strike. We are only minority partners. We cannot do any major role in the NJCA.
6)What about the pension in regard to parity?
The Finance Minister categorically assured that the Govt. has accepted the recommendations in toto and the Pension Department has  been asked to sort out the difficulties in implementation
7)What is the fate of GDS demand ?
Postal unions demand proportionate scales for GDS employees, hence the minimum wage is important to fix salary to GDS.
In the Kamlesh Chandra committee FNPO&NUGDS demand regularization of GDS employees by giving with full justification. FNPO will continue its efforts to get status to GDS like earlier we will not talk much about GDS  but FNPO will do everything as in the case of past.

We are to inform you that the NJCA had a discussion with the Government of India yesterday, i.e.30.06.2016 over certain demands contained in our Charter of Demands. In the meeting, following ministers were present: -

The government has proposed to refer the issue of Minimum Wage and Fitment Formula to a Committee for reconsideration.

The NJCA will await communication in the regard from the government.

The NJCA will again meet on 6th July at 11:00 hrs., in JCM Office, 13-C, Feorzshah Road, New Delhi, for taking appropriate decision.
